    Cash Advance question. Could a credit card dispute this?

    Just looking over my statements on how in the hell in got into this mess. Took a $7,500 cash advance on January of 2011. On January of 2012, I couldn't pay the min payment because it was like $700.00. I have stop paying on this card since Jan of 2012. Planning on filing BK in October 2012. Is this going to be a problem for me? Could the credit card company dispute this.

    The cash advance occurred long enough ago that it would not be presumed to be nondischargeable. The credit card company could still object to the discharge of the debt, but they'd have to prove that you took the advance without intending to pay it. That is hard to prove, especially if you made payments for almost a year. They aren't likely to bother.

    $143,000 in debt discharged for $36,500, including attorneys fees. Money well spent!

      About to say same, but LIR is in CA and knows more of their rules and such. I understand that you intended to pay, but stuff happens. Yes, too far away to say fraud. My own advice and it works for me; don't get CC's after BK. Credit will advance anyway. It did for us into 700 without us attempting to acquire any. We WILL NOT use any except perhaps a car one day. That will be a long day. I'm 230K going for 400. 'Hub

        I agree. I HATE CREDIT CARDS WITH HIGH LIMITS. I know our world uses them. I am good with one credit card set at a $500.00 limit.
