    Hi guys

Is it okay to make (catch-up) payments on the car note after filing a 7, before the 341? I know its hard to reaffirm if you are not current, but what if you get current before the 341 after filing?

Also, what happens to bills, that you have short term payment arrangements with because you were behind? Can you still honor that, or is that just thrown out?

    Thanks guys

Should not be a problem to catch up your car loan.

Regarding payment arrangements on bills - what bills do you mean?

And were the debts listed on your petition?

Filed Chap 13 April 2010. Discharged May 2015.
$143,000 in debt discharged for $36,500, including attorneys fees. Money well spent!

Bill payment arrangements for cell phones, or utilities. In many cases when you are a little behind a company may have special payment arrangements so that you can catch up. Usually they break up the balance owed over a 4-6 month time frame.

Also, thanks for the reply. I didn't think it was a big deal also (car loan), as long as its current by the time I meet with the trustee. Do you think I will have to file any Amendment before 341 once I catch up?

Since you are filing a Ch7, I would wait until after you are discharged to pay anything other than the car. I don't believe it will be problem to catch up if you are only a month or two behind. If you are more than that, then I think you need to talk with your attorney.

As to the other small bills, I would wait until after discharge. Once you have your discharge paperwork in hand, take a look at the back of it. There will be language that says to the effect: "All of the debts are discharged with the exception of court-ordered payments, student loans, and any other type of debt, that THE DEBTOR MAY WISH TO FREELY PAY BACK."
