Ok back to the drawing board. Found another lawyer and need advice on a budget. BTW, I passed the means test. Currently rent is 1500. I have been told by landloard that rent is going up to 1720 in 2 months. We want to look for a house that is $1900.00

Which one can I use???


Second, my Doctor informed me that my surgery is going to requires 4-6 months recovery time. WOW!!! I have been putting it off because of the money situation but I don't know how long I can withstand the pain. With the said, I have disability insurance. It will cover 75% of my salary.

How do I factor this into my budget? I have documention from the surgeon for the trustee.

Means test is only part of the equation - what do your schedules say? Is there available DMI?

My understanding is that you can only claim what you are currently paying as rent. Since you state you're looking to find another rental that is $400 more - that means you have excess somewhere which you're trying to eat up. You cant do it that way unless you're already in a place prior to filing; even then the Trustee may have issue with paying so much for rent.

As to the medical and income issue - everything goes off the day you file - a "snap-shot" if you will of your financial picture. Once you file, generally you cannot include any future medical expenses that you incur after filing.
