    Converted from a Chapter 13 to a Chapter 7 and need advice

    I recently converted from a Chapter 13 to a Chapter 7 due to being unable to make the payments. I had my 341 meeting on 07/18/12 which went well. I have been checking the Pacer website and the Trustee has not entered a report for my case yet. I did notice that he has for other cases with their 341 on the same date as mine. As I was checking the site, I found my Means Test which has several errors. My lawyers office, Paralegal, did my Means Test over the phone and I am now wondering if this is the issue. The errors are substantial from from the national standards for food, clothing, etc to my house payment, amount I pay for health insurance and the list goes on. Any advice on what to do here? This is not the first issue that I have had with my attorney's office and the way they handle things. I am an above the average for income, however I did a Means Test online and I did pass. I realize it's somewhat different but not alot. I don't want my bankruptcy dismissed due to their mishandling of my case.

    Patience. Your 341 Meeting was less than 3 business days earlier, and you are expecting too much too quickly. Remember, that Bankruptcy is a process, not a marathon. While you are a conversion, the Trustee must do a little bit more to make sure your property is exempt before they determine if they're going to file an objection to your claim(s) of exemption.

    I'm assuming that you were under the median and the United States Trustee (UST) didn't show up at your 341 Meeting or ask any additional questions? If not, then you might be in the clear for the "other" line of scrutiny placed upon a bankruptcy case.

    I would wait until 14 days have passed, and even then I would not worry! No news is REALLY good news when you're waiting out the 60 days. Of course, some news would be better, but don't gauge your case based on other cases filed around the same time as yours.
