    Question on switching back accounts and overdraft

    Hi,

    I have a checking account with fell into overdraft about 3 weeks ago (nothing new, just trying to pay bills). I went over by about $500. Had a couple must pay bills come out, and my job paid me 2 wks late. Anyway, its now $1000 negative due to their wonderful fees ( and since Discover ignored my request to not auto-debit, i have 8 return charges on my account).
    I opened a new checking account about a month before this happened (Citadel offered $100 gift card for new account). I have everything switched to my new account, direct deposit, checks, etc.

    My question is, is the overdraft going to be dischargable in 7? Also, will it look like i did this intentionally (i didnt, i have a history of paying overdrafts and getting back positive)? Should i wait a certain amount of time before filing? I retained lawyer and stopped paying cc's in march, but dont yet have the money to pay lawyer and fees.

    OD fees are unsecured debt and dischargeable in bk.

      Hi, lets see, you stopped paying CC in March, opened a new checking account at a different bank a month ago, went ahead and used the overdraft knowing there was not enough money to pay your blls in your old checking, yeah I am thinking this might seem like a purposeful transaction. Might be a red flag now with the fees/OD up over $1,000 especially.
