Need particulars as to how to stop a civil suit with a Ch7.

    You list the lawsuit in your paperwork. There is a place where you have to list any lawsuit(s) that you are involved in, either as Plaintiff or Defendant. If you are the Defendant, and in your case you are, then the Plaintiff is considered to be a creditor, and gets listed in your creditor matrix. The 'Suggestion of Bankruptcy' will go to the plaintiff, and the plaintiff's attorney of record. I believe a copy also goes to the clerk of court for the court that the case is scheduled to be heard in. In any case, once the attorney for the plaintiff gets the notice, he/she will do whatever is necessary. You also will get a copy for your record.

    In our case, we had two civil cases pending before the same judge, and the same law firm represented both plaintiffs. Since we were so paranoid and uneducated about how the process worked (we had not found the forum yet), we made a copy of our notice and sent it with a professionally worded note to the judge in our cases. We had no problems with them.

      OK. It sounds like the Suggestion of Bankruptcy is sent by the BK court to the civil court. I will send a copy to the civil court once it is received.
