Hi everyone. First off, I am so glad I found this site. I've been lurking for awhile soaking in all of the good info in this forum.
My attorney just filed my chapter 7 for me this past Wednesday. I filed a no-asset case, reaffirming my car and surrendering my house. AFTER filing she mentioned to me that there are a few trustees in my district (middle Florida - Seminole county specifically) that are starting to take possession of homes and try to sell and/or rent them. While I understand that I am surrendering my home I was really hoping for a few months mortgage free so that I can save money for a rental. I decided to do some research and found an Orlando lawyer's blog site which directly addressed this practice. In his blog he states that if one forgoes the wildcard and utilizes the homestead exemption then one can protect one's house until foreclosure. I realize it's too late now, but am just curious if anyone else has had to deal with this. I'm thinking maybe I made a mistake not using the homestead exemption but if I'm surrendering the house it doesn't really make sense. I'm so very worried as I have three small children and the thought of being kicked out of my house in a month or two is just terrifying! This is a very scary process and would love some input from the been there done that crew!
