My husband filed for chapter 7 in 2005, prior to the law change to a 8 year wait. Is there a grandfather clause that allows him to file for chapter 7 under the old law, seeing that my original bankruptcy is more than 7 years or does he have to wait until 2013?

Nope, no grandfathering...the law simply changed. Anyone contemplating BK must wait 8 years from the prior filing (regardless if the prior filing was pre, 2005).Comment
