    Question about 60th day when you are waiting for a discharge

    Hi guys, when you are waiting for your 60 days to pass after your 341 meeting, when it finally comes to that 60th day, is it over that morning when you wake up, or does it have to get to like 5pm on the 60th day? Does that make any sense?

    60 days is the deadline for the trustee or creditors to object to discharge, not an automatic date that you will receive your discharge. How soon you actually receive your discharge depends on the procedures in your district.

      The 60th day is the very last day that your creditors have to file an objection to the discharged of the debt you owe to them. In some districts, this may end at the close of the business day for the court; in others it may be at 11:59 PM.

      The earliest that a discharge will happen is on the 61st day, and many factors can affect that. Your district may or may not automatically discharge no asset cases. In other districts it will be done manually. Many courts are backlogged, and it may be several days or even weeks before the discharge happens.

      If it looks like it is taking way too long, call the clerk of your BK court and ask to speak to your case managers. Who that person is, depends on your case number, so have it handy. Say that you are asking a 'procedural question', and that you are wishing to make to make sure that everything is okay in your file, and that you aren't missing anything.

        For my BK the 60th day was June 6th. They got the discharge filed on the 14th. I guess it takes a few days to get everything signed and processed. It's all good!! But like the other poster said, if it is taking "way too long" give the clerk a call.
