    Are Personal Civil Lawsuits to be listed as Creditors?

    I filed Pro Se, my 341 is June 19th. Am I supposed to list the person who has sued me as a creditor? And if so, do I list the crazy amount I was sued for as the amount of claim?

    Yes....if you owe money to anyone they get listed.

      I do not owe them yet. It was only a potential that I owe them if I lost the lawsuit.

        Yes. While I didn't have an individual suing me, there was an individual who was threatening to sue and my lawyer had me list them along with the amount I would have potentially been sued for. He said it didn't matter if she sued me already or was just planning to... by listing her she wouldn't be able to.

          We had a personal lawsuit against us; we were also counter-suing. We had to list both of these.

            I am fairly certain that you have to list it on line 4a of Form B7 - Statement of Financial Affairs.

              You list everyone and everything that you could potentially owe money to. From your creditors to the kitchen sink list them all. Leave no stone unturned......

                Yes, civil suits where you are the defendant get listed as creditors. You can list the debt as "disputed"

                What is the underlying nature of this lawsuit. This doesn't sounds like a run of the mill creditor suit, sounds a bit more involved which may create issues in your BK. e.g. are you really prepared if the persons decides to challenge the discharge of their claimed debt in your BK?
