    Don't believe this

    I was told by my attorney that the day I file they take a snap shot of my bank account and any money I make after I file is mine. I took a commission sales job and have been doing really well. Just now dining out that they look at my pay stub at the 341 and they are suggesting I file a chapter 13. Has anyone eve had to deal with this? I feel like I'm back at square one.

    Schedules I & J are 'forward looking' regarding income & expenses, as of when you file. The trustee may feel you didn't list your correct income on the schedules. Did you take the job before or after you filed?

      especially, if there was a change of employment. i do know (at our 341 chapter 7) we were asked if we were expecting any employment changes or salary changes in the future.

        I took the job right before I filed. It's 100% commission though so there is no way of predicting what it will be.

          If your actual income is higher than what's on your schedules, I suspect the trustee has a good argument. The error was not intentional, but your schedules are wrong.

            Blackgoose, you posted a little over a month ago that you lost your job after filing. Did you have 2 jobs? Maybe the loss of one job will help offset the underestimate of projected income from the other?

            What does your attorney say about all of this?

              I was working a job getting paid with W2. Lost that job and started a sales job. 100% commission and making more. My attorney has been really short and frustrated with me. I just found out today. His words were well talk next week. Just trying to find something out so I don't sit through the weekend with this.

                There was a recent judgement filed in florida regarding this. It was about the SNAPSHOT approach and was just filed about 3 weeks ago (it helped my case a LOT). The bankruptcy is still valid........ if you didn't know about this when you filed I don't see how it will have a REAL impact judging by the snapshot approach.
