I thought student loans automatically go into deferment?

I received a student loan bill for Mohela. It is a federal student loan and I thought they automatically go into deferment when you file chap 7? Not sure what to do with this bill as (1) i can't afford to pay it right now and (2) I don't think I'm legally able to because I'm still in chap 7 and it has not closed yet. I just had my 341 meeting this month.

Was your student loan listed in the BK so that they got notice.

Not a big deal in the grand scheme of things, they might not have processed the BK notice or it was sent to the wrong address (not uncommon).

Keep in mind, it only goes in deferment while the BK is pending, so you only have a few months anyway. You should probably call the student loan company and ask for the bankruptcy department.

I guess I misunderstood how this works. I didn't apply for another deferment or income base payment yet because I thought with a chap 7 the loans automatically get a 3 yr deferment? I'll call them.

I have Mohelia too. They were a month behind when I filed my Ch 7 BK, so they sent me a bill in the first month of the deferrment period.

They were also a month behind at the close of the BK, so everything worked out fine. 3 months of deferred payments.

Not 3 year deferment. Just til your Chapter 7 is finished. Chapter 13 is a different matter.
