ok - well that was a bust!! We were going over the paperwork and it seems my attorney never looked at the detailed notes that I gave! I kept saying it's in the paperwork that I gave you etc. So I am sitting there getting agitated - and then there is there is the issue of equity
in our house - he was using Zillow as a price - no way in hell is a house with knob & tube wiring, asbestos, tiny 70s kitchen and small bath, heating system converted from coal in the 40s, and small bedrooms go for that. Plus NOTHING is selling here, period.
I love my old house and would have lived there forever but I messed up. Oh well - then he brings up my husband not filing - how about bringing this up months ago??????? I'm sorry to vent but wow!!!!!!
ok - the attorney did admit that I was meticulous - I guess he knows I was less than pleased.
So now I need a new FMV for the house - and tell him by Monday if we are still filing together and what the house value is. Will this never end??

Oh carp. So sorry to hear, both about what a *&^% your attorney is and how badly it went. When it comes down to losing the house, you don't go in with a Zillow quote, and he should have known that. Yeesh.
I wonder if you couldn't pick up a foreclosure down that end of the state with your exemption money? I have heard rumors of 55+ places available for around 50k.
Time to make a few more phone calls to other attorneys.

I second GV (Google Voice), its probably the one thing that made the process tolerable and you almost forget you are even going through it while waiting to file(plus you will have a nice little record of calls in writing in case someone contacts you when they are not supposed to). Search it, set it up and get some peace of mind for the remainder of the process! Do it ASAP!

using zillow would be the FIRST sign this atty is not using the correct information. how about using actual comps in the area to get TRUE value.
you can even see in zillow about the current sales in your area for comps..i mean, if they want to use zillow which is so far off in so many ways. they listed our old house has 2 bedroom 1 bath and it was 5 bedrooms 4 baths..just as an example of how they are so off the mark. also their zestimates and nothing ...it should be actual SALES in the area!
i would also think about seeing another atty unless you pay this one in full.

It's more than actual sales. If they went by that my house would be twice the price. Most recent sales in my 'hood have been completely rebuilt from the ground up, granite counters, full second levels, blah blah. I have an ancient roof, a 70's kitchen and other assorted issues that are low priority for us but not for a buyer lol.... you really need your very own appraisal, done by someone who knows the home's true worth.

good point, someone is flipping these houses i guess. we did have one here in our neighborhood as well and they re-did it from head to toe. however, still, compared to a few years ago it didn't go for that much because it's here in florida.

A FMV for your home may take a little time but it shouldn't cost you anything. Usually you can find a real estate agent to give you a CMA for your home or even better a broker's opinion. An actual appraisal is what costs the money, unless you know an appraiser, but is not really needed. We had multiple properties and we used CMAs and a couple of broker's opinions for all but a commercial property and they were all accepted.
