Trustee requested 2009 returns... misplaced my State returns....

    Trustee requested 2009 returns... misplaced my State returns....

    Hello,

    My lawyer mailed me and told me my trustee has requested my 2009 Returns.... I had a copy of the Federal one and sent them a copy but during that year I was at a University in South Carolina, thus I had to file two state returns, both for Michigan and South Carolina.... thus my internet tax return place couldn't do a two state return.... Do you guys think the trustee will be satisfied with just the Federal return? I have no clue if I made copies and if I did, I have no clue where they're at

    Also, is this normal? The trustee requested the 2009 returns and 4 months of bank statements.....

    Pretty normal; and you need to supply the Trustee with whatever they ask. Your attorney (or you, if filing pro se) can contact the Trustee and explain the state issue. However, I suggest that you locate and do whatever paperwork is necessary for South Carolina to send the Trustee a transcript of the tax filling (which most states can do in a matter of days). Don't assume anything - do the work to get the Trustee what he asked for, and explain that you are doing so.

      Excellent advice. However, if you do have the IRS send that now. It reflects both your State taxes as you can deduct some State taxes off your Federal taxes. Send more than required showing your cooperation as more is better than less. 'Hub

        South Carolina says it'll be around 45 days to send me the return, Michigan is over 30.... do you think the trustee will wait this long if necessary?

          There are two things you can ask the state for (and ask the Trustee if he will accept) - a copy of the actual return, which takes a while, and a tax transcript, which is usually pretty quick. Most states, and the feds, offer a tax transcript - basically the calculated numbers from your return in a single or two sheet format. Most states, and the feds, offer a walk-in service for these; however, unless you are actually in the state, that makes it a non-issue for you.

          It's up to the trustee to accept or not accept the timeline, but if you are showing effort I am sure that would be taken into consideration.

            if you had your taxes done by an accounting firm, the wll still have or should have copies of your returns even for 2009. if you did use an accountant i would call and see if possibly they have a copy in their records for you.
