    Trustee Differences

    I read the different posts on here and I am amazed at the differences seen in trustees. I have seen where some trustees want every little thing reported and verified and others...not so much.

    I have my 341 tomorrow and I think (fingers crossed) that I have a more laid back trustee. I haven't even filed my 2011 taxes yet and my attorney said not to worry about it. "She won't want it. Looking at 2010 and 2009, she will see that there isn't that much to go after." There also were other differences. I didn't have to list any household stuff or jewelry. He just asked if everything was lumped together, what would I think it would be worth. Duh. Then he said to just bring Drivers License and SS card. "Everything will be fine."

    So far, Ive been pretty calm about all of this, but as the time gets closer (tomorrow afternoon) I'm getting a little antsy. I know it will probably be OK, it's an easy 7. I don't have much and haven't used a CC card in well over a year. Mortgage is current and gonna do a "stay and pay." Should be fine!! But....I'll post again tomm and let you know how it goes.

    And once again...TY all for the support and advice I have received here. You really helped me stay calm and informed about the process!!

    Good luck to you tomorrow! Try to get some sleep tonight--yeah, I know. Just leave plenty early to allow time to get to the building, in case there are any traffic problems.

      Good luck tomorrow. My meeting is the 24th and all I was told to bring was my SS card and Drivers License. Everything was lumped together for me as well. They haven't asked for my 2011 tax return but I did get it done and will bring a copy with me just in case they ask for it which they can do at the meeting and then you'll have to send it in. I don't want anything holding it up once the meeting is done.

        All we needed was SS card and drivers license. Be careful what you bring with you as the trustee can ask for any paper work brought to the meeting. If you really think you must bring something, have your attorney bring it or give it to them just before the 341 to hold during the meeting. My advice is don't bring anything beyond the SS card and drivers license unless told to by your attorney. By this time tomorrow you will be wondering why you we're so anxious today.

          My attorney will be with me. I would just assume they use the 2011 tax return it's worse then the 2010. They can have my state tax return as well since between the two I owe $1400.

            Regarding Trustee differences...

            Each Trustee will certainly have their own bugaboos and "specialties." The forums here are full of stories.

            One thing I can certainly guarantee is the same across all Trustees is this...If the file looks funny, seems funny, smells funny, or has anything kinda poking out of it in a funny way - it will get the extra attention you would hope to avoid.

            In your case, DaisysMom, your attorney is probably correct in assuming that the last two years' history shows that you likely have nothing to hide. Now, if your taxes showed income of $250,000 and all you claimed as assets is an IKEA footstool...that would smell funny.

            Good and experienced attorneys can probably tell you what the Trustee prefers for lunch. They SHOULD know them about that well if they have been doing this for any length of time. That said, every person - and Trustees are persons - has a bad day. But, generally, any one Trustee is usually fairly predictable. Now, if there were only a way to predict which Trustee anyone will get...

              bt..so agree with most everything you said.

              however, i don't know if it's that the trustee's in this country are starting to see the end of the rainbow with an empty pot of gold, but it does seem to be far more that scrutinize even the smaller issues when dealing with some of cases i have read about, which a year or 2 ago would have gone through the system in a ny minute. of course i can't think of one right off the top of my head at the moment. but i believe that the "rush" on the filings are slowing down and the trustees are going after whatever and whomever they can if they think or feel a penny could be had..or better stated, put in their pockets.
