    Checking Account Before Filing

    I have about $2k in my checking account, and I'm going to get paid again next week. I have my last meeting with my attorney before filing. He said that I want to get my checking account below $1k for the filing. Do they look at what you're spending on before you file?

    I'm in luxury sales and need to look the part. Is it ok to buy clothes? I don't want to do anything to jeopardize the situation. My son is on heavy duty meds, too. I supposed I could buy ahead.

    Any thoughts are appreciated.

    Every jurisdiction is different so consult with your attorney. In general, the trustees understand that you need to live so any expense for food, cars, medicine, utilities, etc is acceptable as long as they are not excessive. Filling the pantry and freezer are common examples cited on this forum. Be sure to have full tanks of gas in your cars. The more time between these purchases and filing the better. Most will suggest that you keep all receipts for these purchases, but I don't remember anyone having to provide them. (we had our reciepts.) Pre-paying insurance, property taxes, car payments, etc can be viewed negatively by the trustee so be careful doing that. As I stated up front consult with your attorney before doing any of this. Best of luck with your BK. It will be over before you know it and you will be enjoying your fresh start.

      Agreed - what you can purchase is very much a local Trustee com for level decision. Your atty will know what they will and will not allow. I am betting clothing will not fly, however. What you want to do is NOT have to explain anything - you want to have a file and case that is as plain vanilla as the rest, with nothing sticking up. Designer clothes, however justifiable, will only attract attention if purchased (or worn to the 341).
