    Living hell

    Had a local credit union who I owe $15k to on a credit card call my mom twice tonight asking for me. Isn't there a law that states they can only call a family member once?.. period!!

    Also, will I have to list my $1,200 rent deposit as an asset or something in a chapter 7? Could my landlord lose that? Thanks

    Sorry to hear that, I assume your mom knows you are filing? Have you set up Google Voice (GV) yet? If so see if you can change your number with them, maybe if you contact the person that called your mom directly and give them the number directly they will only call you (call GV) from this point on. Better yet, perhaps you can have your mom give them the GV number next time they call (she can just tell them that this is your direct number) and as long as you are clear on your out going message with your identity and address information then they will have a "good" contact number for you and stop calling her.       We are filing in June so it sounds like our time lines will be very similar. I hope the outcome goes well. I get so nervous just thinking about it.

        they cannot continue to call your mom after she tells them you do not live there.

        if it were me, i would fie a complaint on your mom's behalf with the FTC

        i filed about 20 of them and they stopped calling but our reason was a bit different and a bit ironic. we got a new phone in a new state and the person who use to have our new number owed everyone and their mother and their mother's mother. of course, the banks and all the creditors didn't' believe me when i told them they had the wrong person. i mean it was 30 times a day for wells fargo, boa, chase, discover, ALL of them this guy owed. so finally, i kept them on the phone long enough to pull up on my computer the site i listed above, i turned the conversation to the form of questions and then began typing as they answered. when i was done, i said thank you for your time, you and your company who have been told repeatedly we are NOT the person you are looking for, have just been reported to the FTC and i hope you get a FINE so big that you get fired.

        hang up ! by the way the calls STOPPED! all of them.

          I would start on a state level since you stated it was a local credit union, they’ll want to stay in good standing in the state. I found this, but you might want to verify if the is the correct department to call.

          As for the rental deposit I believe unless you exempt it the trustee can view it as an asset, and could go after it. I am not sure but would it be like when a trustee goes after a tax refund they are only entitled to a % of the total amount, I would ask your attorney.

            most states consumer potection divisions are limited as to the scope of what they can do. generally, complaints are usually but not always cover consumers and merchants complaints and do not deal with federal law compliance issues. the addess i listed above will just cut to the chase.

            this is a federal matter, not so much a state even if it is a local credit union, they are (i'm certain a general complaint won't hurt, but at some point one must chose their battles), still under the guidelines of the FTC.
