Hi All! My husband and I have been lurking around here for a long time now, just never signed up. We were recently discharged and closed in December with our No Asset, CH7. We completely forgot about a medical bill we had. It was one of those things where we didn't get notices or calls everyday like the CC's, so it slipped our mind. Anyway, we just received a letter from a law office about our medical bill and was wondering if I had to re-open our case or we could just send them a copy of our discharge and closure, even though they weren't included in our Chapter 7.

It's not "considered" discharged... it "is" discharged. Even though it was not in the filing. All you need to do is send them a copy of the discharge order along with a nice letter telling them that "the debt was discharged in a bankruptcy on XX/XX/XXXX and a copy of that discharge order is attached". Make sure you tell them, in the letter, that any further collection activity would be a violation of the permanent discharge injunction and may subject them to an award of damages.
In 99.99% of the cases, they will go away! They should go away because a discharge wipes "all" debt that arose prior to the filing of the petition.
Send the letter and copy of the discharge order certified mail return receipt requested.Chapter 7 (No Asset/Non-Consumer) Filed (Pro Se) 7/08 (converted from Chapter 13 - 2/10)
Status: (Auto) Discharged and Closed! 5/10
