    question about 90 days since last use of credit card

    Is it 90 days from the date of filing or 90 days from 341 hearing?

    I used a card for necessities on 11/20/2011. I don't want any problems with my filing. Just want to figure out the timing.

    Also do I keep paying that card? The minimum is only $13. So I can pay them up until I file. Can I stop paying the other cards I haven't used?

    Confused about this. When is it cool to stop paying?

    Last charges were $23 (food), $26 (flat tire repair), $34 (car door repair, flew open on highway, wouldn't lock) $135 (replaced a broken sewing machine). All charged on the same card. Card only has a $800 balance. I wouldn't even be upset if the trustee doesn't let me discharge it.

    It would be the least of my worries.

    I want to file after I get my IRS return. Half of it will pay the rest of the attorney fee. And I need new glasses and other allowable expenses.

    Just trying to figure out the timing.

    If I stop paying all my cc's now, even though I used the card on November 20, would the trustee find a problem with that?

      If bk is the endgame, stop paying all unsecured debt.
      Nobody is going to worry about $200 worth of charges.
      Here's what the code say about recent charges:

      i) for purposes of subparagraph (A)--

      (I) consumer debts owed to a single creditor and aggregating more than $500 [$550] for luxury goods or services incurred by an individual debtor on or within 90 days before the order for relief under this title are presumed to be nondischargeable; and

      (II) cash advances aggregating more than $750 [$825] that are extensions of consumer credit under an open end credit plan obtained by an individual debtor on or within 70 days before the order for relief under this title, are presumed to be nondischargeable; and

          If you are using your CC as recently as November to buy food, do you have enough income to budget for your everyday living expenses after you file. You won't have any credit to fall back on once you file.

            If I can stop paying these credit cards I can pay all my bills with cash.

            Im using almost one whole paycheck on credit card debt every month.

              You need to stop paying the CC now and use that money towards an attorney.

                I was only paying the one I used last. The minimum is only $13 so I figured better safe than sorry....over $13.

                I have 3 appointments with attorneys for next week. Nothing is due until after that.

                  we used our cards 30 days before we filed. But those were for everyday expenses, fuel, food, household.

                  We did the same thing. If you are thinking about filing, stop paying the cards, even if it's 13 dollars a month.. Stop paying it... That will be 13 dollars a month you will not get back. Save all your money for an attorney.. You'll need anywhere from 1200 to 2000. Possible more depending on your case.

                      The 1st would be partially correct. The OP is going broke monthly because of paying on CC's every month.. Charging them up, then paying on them again..
                      Once you stop paying on the cards, you'll have extra money for the house hold goods and bills.

                      Stop paying all credit cards. They will be discharged in the BK.
                      Only pay your normal monthly bills (Mortgage, car note, utilities, cable, phone, etc) in cash if you can pay at an office.. Otherwise get a money order and pay that way.

                      If you are going to file BK, it's doesn't make any sense paying on your credit cards. (If you want to waste that money,,, You can send the money to me )
