I'm in FL and was not able to use a Carmax appraisal. My trustee used KBB and pictures of the car.

And I was not asked for any receipts.

I had about 8 months worth of receipts saved, brought them with me (along with every thing I could think of except the kitchen sink, LOL) and was never asked for them. Our 341 was the quickest of the ones we witnessed. (we arrived one hour early because at the time of year of our filing that area is a zoo with xmas).
      Chapter 7 filed 11/4/10 ---- 341 Meeting 12/1/10 ---- Discharge 1/31/2011.

        Freddy03,
At what point were you asked to provide pictures? (before or after your 341?) Did you provide the pics, or did the trustee want to send an appraiser to take them? I am also in Florida, have a 15 yr old vehicle that Carmax offered $1,500 for, and I listed it on my schedules at $2,000 since I knew Carmax was frowned upon by trustees here. KBB is more like $3,200, but, mine has 125K miles, dents, and A/C plus other interior problems. My 341 is coming next week, should I take pics and bring them with me, or is it better to just wait and see what, if anything, they ask for?

Hi Cabana -you are in SW FL too? me too......we have filed and our 341 is coming up next week. I have all receipts because I am an accountant and this is just the way I am and always have been ...I will let you know if the trustee asks for receipts. Our Atty says she most likely will not ask for anything other than the bank statements for the last 90 days prior to filing which we have provided.

Filed....we are in FL as well......our trustee uses NADA retail value so our atty had us take one of the cars to a local appraiser who is authorized by the local courts here.. he sent the appraisal report to our attorney. Our 341 is next week as well. I will post the outcome on here. Our atty also told us to bring nothing to the 341 unless he we here from him specifically. If the trustee needs more they will request it at that time. Good LUck next wee...I hope our's is uneventful as well...

Have you gotten any flak from anyone about being an accountant and yet being in a BK situation? Just wondering, as I have gotten some ridicule of those saying that because I am an accountant I should have known better! Yet, those same people are not looking at WHY we got into this situation in the first place. Our family went from having a good income to NO income. Show me one single family, who isn't rich beyond the stars, who can lose both spouses jobs and still survive without some sort of financial intervention. I am a little bit bitter over it, I suppose. Nothing like hearing how I will never work in my field again if I file for BK. Pure bull hockey, I can assure you. I have heard that most banks are not even doing credit checks when they hire you now. In fact, while I have been job hunting, the only places I have come across that state they will require a credit check, were AAA and an uniform company. Very odd....

Yes, please report back on how your 341 goes. Good luck! I'm sure it will go great.

Cabana...No, not a lot of slack but we are pretty private so not a lot of people know. Besides those that do know are aware that the reasons we did have absolutely nothing with me being an accountant. I still have my job and I don't plan on jumping ship anytime soon. I spoke to a gal at one of our local branches who is with Bank of America and she had filed a Chap 13 about a year ago so I am not too worried about it at this point. A lot of people all over the country are having to file. 341 is in two days....will report back...have you filed yet?

Nope, we haven't filed yet. I just got laid off for the second time in 3-4 years so I am not happy. But we will be filing in December. The foreclosure is moving forward...fianlly...so now is the time to do so. I just wish I had a good paying job to make post BK a much happier time. The plus side of it is that there are more jobs available now than there were when I was laid off the first time. So hopefully, I will be gainfully employed again soon. The the savings can begin in ernest.

BCabana- had 341 this morning in FL, and just wanted to let you know that our trustee did not ask for any receipts and did not question any purchases at all and we had to replace our AC compressor in July (2,200) and our stackable washer/dryer unit in August (1,100) so there were several purchases trustee could have drilled us about and didn't. Trustee was only interested in assets. So if there is anything they can take they will. So just a heads up.....Hopefully your's go as smoothly. I think we got the least favorite trustee in this area and it didn't go bad at all.

Congrats! We really don't have much in assets but they may go over the exemption amount by a couple thousand at the most. We will see what they do! As long as I can remain emotionally detached from my assets I will be fine! LOL!!
