    This will decide everything!

Hoping to clarify. Utah it says only $5k for non primary residence. We just moved a month ago into a rental home. We rented out our home. Does that mean we only get to use the $5k homestead?

In your other post, you mention that you have 15-25 in equity. Where are you getting those numbers? You might want to get a few brokers to come by. Be sure to point out anything that is wrong with the house. OR get a repair guy to come by and give you estimates on whatever needs fixing.

Why are you renting out your house?

Not sure what your other exemptions are. Could be there's a wildcard that could cover excess equity. Could be you'll be an asset case for awhile. A lot depends on the tt and the appraisal. If he thinks he can make money on the house, he might try. But remember he has to pay realtor fees, so if it's too close, it may be abandoned.

Good question to ask the lawyers.
