I'm involved in a civil law suit where the judgement can go either way. The court date for the dispute is in a few weeks. I filed earlier this year for a CH 7...made it almost all the way but had the case dimissed because I didn't pay the filing fees (I think I should have gotten an exemption). I know I can request that my case be reinstated, but I also don't mind starting the process over...especially since I now know all the ropes.
If I reinstate the original case...I'm not sure if it will be immediately discharged...since I had the 341 and went through the 60 day waiting period already (it was dismissed a few days before the 60 day time was completed)...and if it is immediately discharged, I'm concerned that if the civil case goes against me...I wont be able to include it. However if I file a totally new case...can I later add the civil judgment if it goes against me. IOW if I file a ch 7 now..can I add a new judgment next month?
