    Getting garnished wages back?

    Has anyone had wages garnished after filing been able to get that money back?

    We had 2 paychecks garnished after our file date and the judgment creditor has told my attorney they sent the money back to my employer. I'm just curious how long this takes or do I have to wait till after discharge?

    Anyone experience this?

    Your employer should give you back your wages after they are received, and on the next pay cycle. If not, start complaining......

      You should get it back. Practices vary I am sure, but usually the creditor sends the money directly to the debtor, not back to the employer. But if that is indeed what happened, contact your payroll people and start being a squeaky wheel.

        The money could also get sent back to the court system that ordered the garnishment. I've seen that happen a few times.

            Hi Freddy

            I have, start now don’t wait for the discharge. Depending on timing, where the check was sent, if the Jupiter is in alignment with Saturn (kidding) your payroll department/company might not even know what/who the check was for.

            Did your lawyer get any more detail from the creditor like what date the check was cut, total check value, remittance address, department it was sent to etc?

            If you had more detail you could contact your payroll dept and say for example: on August 15, 2011, a creditor named Dewey, Cheatem and Howe mailed a check for one million dollars to the following address etc, have you received it and what is the process for returning the funds to me.

                Update

                The garnished funds were in my direct deposit this weekend! Woo Hoo!!!

                I was finally able to put breaks & new tires on the car and for the first time in a long time we actually had money left over after paying all the bills!

                Our moving fund has officially started!
