    On Filing Date

    I am signing Friday. I guess thats what they call it, is that the actual filing of my bk 7? What usually happens on this day? Ive been dodging creditor calls left and right. My stress level is so high at this point I want to crack. TIA

    You will feel better after you file, and when a creditor calls then, just say
    "I have filed BK, and my attorneys name is _________ and the phone number is ________." They will drop you like a hot potato then!

      The day that you sign and actually file are 2 different things unless of course the day that you sign your paperwork is the same day as the stamp that the BK clerk places on your papers. I did my paperwork over the weekend and I signed April 18 because that was the day I intended on going to file.

      I was elated to file, but also sad as well because of the total situation and how things might have been different.

      Once you file you have to get over the guilt and think about the positive things that will happen. I can't wait to my phone stops ringing off the hook from people leaving a name and #800 number. I let my machine answer the call.

        There is no guilty, as far as I'm concerned. It is our constituional right to get a "do-over" when things get too bad. That's America. While it is a tough emotional decions (because the credit card companies make you feel so bad), it is the best for alll concerned. And I didn't even have credit card debt

          Filing Date

          Im making my 2nd pmt, and I sign at the attys office. Im not sure when they will place it in the BK clerks office, but it may be done the same day since my atty is the judge too. But I know they told me to not answer anything or even say I am filing BK 7 previously, but I wasn't sure about now. Ill be glad once I get this all over with. My atty said that It whould take about 5 weeks from filing to hearing or sooner since its a no asset.

            The Creditors will also ask what Ch you filed and what your Case # is too. So maybe put a Post-it by every phone with all that info to be prepared when you answer the phone.

              Actually they will be congradulating you and making new credit offers at higher rates. When (not if), but when they do this, don't play anymore.

                If all your papers are complete, and you sign on Friday at your attorney's office, there is a good chance your attorney will file it electronic on that day. One of the good things about the electronic filing is that it can be done 24/7.

                Make sure when you sign and if your attorney indicates they are going to file that day for you, that you really look the papers over well. Check name, ss#, ect. Hell, they had my name spelled wrong. What sucked, I didn't notice that until I was home. My head was swirling so much that day, didn't know if I were coming or going.

                    Wait! You better check with your attorney. If you're filing chapter 7 and you're making payments to the attorney.... it is VERY likely that they won't actually file until you have paid in full. In fact I can't imagine an attorney filing a chapter 7 UNLESS you had paid in full since once he files your money no longer belongs to you and you could just include his debt in with your bk and never pay him.

                    The ONLY way for you to be sure when you file is to ask that specific question to your attorney. Do NOT just assume that because you signed an agreement with the attorney that he will file that day or at ANY time until you have paid his fee in full unless he specifically tells you that he will file on a certain date irregardless of if you have paid him in full or not.

                      Signing

                      Im back its going to be placed in electronically on Monday, what he does is we make the 1st pmt of 225.00 on 2nd visit, 450.00 on signing and 455.00 on 341 date or the BK will be pulled. Theres only 3 in my area and hes done over 21,000 in the past 3 years. I am kind of worried becasue I am at the very end of the means test( income wise) . My hubbys income (but hes not filing), my lawyer said I should be good with Chapter 7.Ok I talked to the lawyer. I am doing a Chapt. 7. phew. It will be filed on monday and should be in the PACER by Tues. Once I get my case # I can give it to the creditors. So when should I start cleaning up my credit report, when its all over with? TIA
