    Paperwork ready... One more question

    The attorney has the paperwork ready to sign and our pre counseling certificates were emailed today. My question now is, I have a pending lawsuit (Crap One) and court date one week from tomorrow, how much time is needed to stop the lawsuit? Any help would be greatly appreciated. Thanks in advance!!

    Once your BK is filed with the court, you have an instant automatic stay. You or your attorney needs to send the automatic stay papers to Crap 1, their attorney, and the court. That will put on hold the case, and hopefully dismiss it.

      Angelasdad is correct. We had a pending lawsuit over a vehicle that 'Hub foolishly cosigned for an acquaintance, and a pending lawsuit for a loan from American General. Both were dismissed.

        Right!!!! At absolute WORST, you can even show up in court, introduce your stay issued a second before the court date, and case gets stayed/non-suited/dismissed (based upon your state's procedures). We had one and atty mailed (spouse's 13) the stay to court where it was sent to the Clerk's office, and it got there like two days before the court date...online it showed in RED letters - NOTICE OF BANKRUPTCY HAS BEEN FILED...and case non-suited :-)
