    Is getting a better job bad news?

    Well, one more thing to add to the rollercoaster ride. In the past this should/would have been good news. As you may have seen from my previous posts we were planning on filing in Oct./Nov. My income was about to drop substantially due to a reduction in hours at work. We are over the means test but have negative dmi so our attorney said it would only help us to show the decrease over the next two months so let's wait it out.

    I found out today I may be offered a fulltime position with a substantial increase which will definately putting us into a 13 with probably quite a high monthly payment! Just when we thought we'd have it all figured out! Job would begin in 3 weeks. So my question, don't we need to file NOW and based on our current income before our income may increase?

    PS We have 1 summons with a court date and another on it's way...

    YES! Two suits heading your way, squeek this through fast. BTW having ANY job is good news. Try being in your fifties and get laid off. You may consider it a forced retirement. Mrs. on fourth year of UC which is a pittance, and more trouble than it's worth. She needs five applications per payment. There are NO jobs in our area. There is a waiting line even to pick cans up along side the roads. Our County is 22% unemployed and near a third of the houses empty. Of course entrepreneurs are selling a LOT of copper and air conditioner condensers. 'Hub

      I hope I didn't come across as flippant. I am so grateful we are employed. I live/work in Detroit so I know first hand what you are speaking of. The whole reason we are in this mess is b/c my DH lost his position after 25 yrs in TWICE due to offshoring AMERICAN JOBS. I lost my position for 9 months as well. This was well over 2 years ago and we had to ultimately turn to BK to give us a fresh start. Looking back, I wish we would have come to grips with our situation earlier which would have made this process a lot more cut and dry. My biggest fear now is getting into a 13 with a high payment that will put us back right where we are for the next 5 years! God Bless your family Hub, I hope your wife finds something soon.

        My opinion...just my opinion...

        If you can qualify for a Ch 7 rather than being forced to a Ch 13, I say do it.

        If a 13 is a better option for you because of...well, I can't really think of much here...then file a 13. Otherwise, take the Ch 7 and move along with life. There is nothing better than the feeling of a new opportunity without debt, and with new income.
