    No Distribution = Passed Means??

So, we got the information from Pacer that our trustee reported no distribution and asked to be dismissed from our case. Does this mean we passed the Means test??

    341 - July 26th

    On Pacer:
Chapter 7 Trustee's Report of No Distribution. The Section 341 Meeting was concluded on 07/26/11. I, **, having been appointed trustee of the estate of the above-named debtor(s), report that I have neither received any property nor paid any money on account of this estate; that I have made a diligent inquiry into the financial affairs of the debtor(s) and the location of the property belonging to the estate; and that there is no property available for distribution from the estate over and above that exempted by law. Pursuant to Fed R Bank P 5009, I hereby certify that the estate of the above-named debtor(s) has been fully administered. I request that I be discharged from any further duties as trustee. Key information about this case as reported in schedules filed by the debtor(s) or otherwise found in the case record: This case was pending for 1 months. Assets Abandoned (without deducting any secured claims): $ **, Assets Exempt: Not Available, Claims Scheduled: $ **, Claims Asserted: Not Applicable, Claims scheduled to be discharged without payment (without deducting the value of collateral or debts excepted from discharge): $ **

    Thanks!!

No. It does not mean that you passed the means test. The dismissal of a case is generally handled by the Office of the United States Trustee (OUST or UST). That office would have been at your 341 Meeting or contact you or your lawyer shortly there-after should there be an abuse issue (usually within 10 days of the 341 Meeting).

So, if you don't even know what a UST is, and have heard nothing, you can generally relax. Just wait out your 60 days and you should be good to go!

Thanks! I'll watch for the UST status as I am only about 3 days post 341. There was no UST at my meeting, though.
