Converting from Chapt. 13 to Chapter 7 - What to expect and new 341 mtg?

    My attorney is on the ball but I am probably one of his more "needy/inquisitive" clients. I am constantly firing questions at him about what if this happens, etc. He is pretty prompt at returning my emails but most of the time he would rather talk. I tend to write small novels and I think it is easier for him to call me and answer the questions in 5 minutes versus the back and forth banter in emails.

    I thought you were ahead of me but maybe I am ahead of your in the process? Either way, best of luck to you Donna 123. Hopefully, we'll both end up with successful conversions.

        Just got my formal documents from the court that my 341 meeting is on Sept. 13 @11:30am. Also, received a letter from my Chapt. 13 trustee addressed to my company to stop the wage garnishment effective August 8th.

        Need to ask lawyer a couple of clarifying questions and I'll keep everyone in the loop. Just skimmed the paperwork and need to re-read it a couple of times to let everything settle in.

          Update,
          Our conversion to Ch 7 was filed also & have a 341 scheduled for 09/14/11, so getting ready to take the credit counseling course for the certificate required. We used Cricket for the initial filing of ch13.
          Will let you know how it all goes.

            Okay, had my 341 meeting on 09/13/2011. The trustee was raking a lot of the people over the coals about money spent prior to filing, where the money went, where were the receipts, etc. When it was our turn, he asked us the usual questions he was asking everyone. The only out of the ordinary questions he asked was why we were converting from Chapt. 13 to Chapt. 7 ( loss of income and health issues) and were we confirmed for the Chapt. 13 and how long has it been (yes, and about 1 year). He looked at us and said have a good day.

            I couldn't believe it was over that fast when he was grilling everyone else. Just very thankful...my nerves had been a wreck.

            Looked at Pacer today and it said:

            "Chapter 7 Trustee's Report of No Distribution: .....I have neither received any property nor paid any money on account of this estate; that I have made a diligent inquiry into the financial affairs of the debtor(s) and the location of the property belonging to the estate; and that there is no property available for distribution from the estate over and above that exempted by law. Pursuant to Fed R Bank P 5009, I hereby certify that the estate of the above-named debtor(s) has been fully administered. I request that I be discharged from any further duties as trustee....".

            I am guessing that it is a good sign. Deadline for filing Presumption of Abuse (PoA) is this Friday. Fingers crossed.

              @tShoot, since you surrendered the house, what was that process like and how quickly do you have to leave it?
