Just curious if anyone has filed with not being current, does the mortgage compnay give you an opportunity to make up the back payments!

Doin it right now! Dont know the answer for you yet....I applied for a loan mod which has bought me some time...would be great if the approved that, but dont know yet. THEN, I had a repayment plan approved with them (lump sum then extra payments each month for about a year) before I filed, but Im not sure whether that will be offered to me again after the BK since the loan will be discharged by then.
I ll know in about 6 weeks!

We are behind but all within the month never past a month.....I am nervous want to keep the house, reported current on all our credit reports....I asked the attorney but never got a straigh answer! I am going to file a modification...but don't know if that will prevent a foreclosur or anything, funny thing is this past month they took out in error an extra payment, and they refunded it! so, I don't know if I am considered "current" in there eyes or not...this whole thing has me crazy!!!!

If you're less than 30 days late, I don't think a foreclosure is in your future, I wouldn't concern myself too much with that. I was 3 months behind on my car payment when I filed, but I was on the fence as to whether or not to keep it, decided to keep it and simply paid it to current before I signed the reaff, and I had no grief from it.

After our discharge and not paying mortgage between the time we filed and the discharge, we received a letter from the lender telling us how much we owe including fees and interest. We plan on letting it go in the BK anyway so it did not matter, but if we decided to keep the property we would have to come up with the chunk of money and continue paying in order to keep it.
The bottom line is the banks can only foreclose as fast as the laws in your state allow. They can drag the foreclosure process out, but not foreclose any faster then the law allows.
