Have another question plan on filing in Jan. Owe tax they take my income tax check every year. irs If I file chap 7 wil it be a asset even though i owe have been paying monthly also.... do not get back much 700 to 1000 that they take.

Are you asking if the refund check from the IRS will be an asset? I also owe tax debt and my refund was intercepted by the IRS. IRS debt is a priority debt in bankruptcy. My trustee did not even ask what happened to the refund, even though I had the letter from the IRS stating that they intercepted it.
My tax debt was listed on my petition as well.
