    "Presumption of Abuse does NOT exist", Notice, questions

    Just received our official Notice and scheduled meeting of creditors. It says "presumption of abuse does not exist". Our attorney told us when we filed that we would hear in approx 2 weeks whether or not the US bk court would question our case as an abuse case. Can I assume that we are free and clear of any question of abuse? Or, can they change their mind at a later date? There is no abuse, but just wondering if this is the "official" last word on that issue.

    No, what you received is pretty standard. It's the notice of the official filing and more informational than anything. In your filing your attorney checked a box that stated "no" to presumption of abuse. That is why the letter you received states that.
