Finally-6 weeks after filing my wage garnishment has stopped!

Man was this a pain in the hind parts...I had a state tax garnishment, they were taking 25% of my net pay each week (I'm paid weekly).

After numerous emails to the state, communicating with the state attorney's and my payroll department...FINALLY...this week, the garnishment has stopped.

I really don't believe my attorney did one single thing for me in this process, I have some choice words for him but I'll save those until I am discharged.

I fully intend on paying the tax debt of course. But after discharge, I will return to the payment plan that I was initially on before I lost my job and then became underemployed.

All I ever wanted was the rights I am entitled to under the bankruptcy laws. I expressly said this to the state's attorney and my payroll department so both were aware that I knew my rights.

My suggestion to everyone....AVOID A WAGE GARNISHMENT....

My garnishment hit me by surprise...I was laid off and returned to the same company and the garnishment was in place before I received my first paycheck...I was never informed that they had a garnishment order...I think they are obligated to tell me....oh well, wasn't much I could do about it at that time.

Your rights are protected by filing bankruptcy, the automatic stay does in fact stop a garnishment order....but actually getting everyone to cooperate takes some time, it is not instant by any means.

Now...the next step...get the 6 weeks worth of money back that the state took from me that they were not supposed to....I'm sure I'll receive that in about 57 years....LOL

But of course! I have pop tarts and OJ on stand-by...no fancy eggs, pancakes, bacon, sausage etc. The Stormtroopers have to move quickly...no time for a sit down breakfast. Hopefully they'll let me partake in a snip-pit of pop tart elegance before they haul me away.
