    Just decided to file chapter 7

    Hello everyone. This is my first post. Never thought I'd be here.

    I have been in debt management for 15 months. This past weekend I received a letter from my state saying they are closing my child support case from my ex. Now that I have lost that income, I know there is no way I can continue to pay DM payment. (CS was suppose to end next May - I have prepaid legal looking into it.) My plan was next May I would quit school and get a part-time job. I do work full time.

    My debt is mostly credit cards and minimal hospital bills. My husband and I are seperated and have always had seperate finances so this should not affect him. I'm not sure how soon we will divorcing. He's on my healthcare so I hate to take that from him to soon and he also pays my car payment.

    I guess what I am looking for is to find out what is exempt. I own my home but I may actually be upside down on it now - maybe 20-30K. I'm ok with that because I can't live anywhere else for what my mortgage payment is. The market will bounce back one day.

    My car will be paid off next May and just recently I (with some help from my mom and husband) bought my daughter18 a used car and it's titled in my name.

    My only other asset is my 457 through work that is valued at about 7K.

    Without the child support I am about 500 upside down - I talked to my debt management counselor and he was pretty certain that I would qualify.

    I am concerned about what can be taken from me. My car? My daughters car? should I retitle the car and put it in her name? My 457 - I would have to show extreme unexpected hardship to my employer before they would let me have it and I don't think I can do that.

    I live in FL and any advise would be greatly appreciated. TIA!!

    Also - what personal property can they take? Are they going to come into my house and take my tv and stereo? I really have now idea how BK works.

      Welcome KLS - there are quite a few FL experts here, and they will help you out!!

      You are not alone...as you can see...

      I can tell you that your 457 is exempt (all the "fours" - 401k, 403b, and 457's for state/local gov't ee's are exempt)

      Take good care of yourself!!!

      And they're not going to come and take your stuff - your exemptions (and the FL experts will be talking to you!) will cover that...unless you have a diamond studded couch :-)
