We were discharged from Ch 7 on 3/1/11. During our 341 hearing, the trustee told us to submit our tax return for 2010, and that we could possibly have to give up any tax refund due us. He did send out a Notice of Possible Dividends on 12/21/10. As soon as we filed our taxes, our attorney sent the trustee the information. The next day, the case was discharged, but it still remains open.
When I look at Pacer, I see that the case catagorized as an Asset case. It shows the status as "Awaiting Closing". It has been that way for 93 days.
We have received our tax return from the state and IRS. It came out to around $2700. We have not spent it. We are waiting for the trustee to contact us.
How long does it usually take for the trustee to finally request the refund? How long does it take for him to close the case? Is there a chance that he will just let us keep the refund?
