    Resorting to Murphy's Law

    BK discharge was due 2 full weeks ago on a simple no-asset, below-median BK in CO.

    I hate PACER. It's the devil. No updates since the BK trustee was paid over 2 months ago.

    So here is my brilliant idea: if I just put a new message on the board about how infernally long this is taking, about how archaic PACER is, and how endlessly frustrating the wait has been, then shouldn't Murphy's Law kick in? As soon as I whine and wail and throw an adult tantrum, shouldn't the case miraculously be updated on PACER so I end up looking like a completely spoiled and overreactive idiot? I'm willing to pay that price!

    Ugh! How long can this go on?!? My dead grandmother could update that database faster!! :::stomping ::: snorting ::: wheezing ::: kicking ::: snot flying :::

    (C'mon Murphy, that's your cue)
    OK - from now on it's not a "Bankruptcy." It's a "Weight Loss Program." I'm in. Sign me up.

    LOL...I love this post. I like how Murphy's Law tends to work out....if I really am waiting on something or someone, I start doing something else and inevitably, who or what I was waiting on turns up....

    Hope the process speeds up for you...

      As a matter of fact, that aforementioned law IS one of my names! LOL.

      Call the clerk of your BK Court, and ask to speak to your caseworker. Have your case number handy, as the number determines who is assigned to you. Ask that person if there is anything missing from your file? He/she may tell you that you need to ask your attorney, if you were represented by one. And you can simply say that I am just checking, as my Discharge should have come two weeks ago.

      We dragged on almost two months past our expected Discharge date. 'Hub finally called the caseworker. And was told that the hold-up was the lack of a copy of our Marriage License in our file. We had it with us as instructed at our 341, but when we tried to give it to the trustee, he said he didn't need it.

      Well, it WAS needed!

      Once it was uploaded, we were Discharged within the hour!

      Let us know what you learn. Your hamsters are waiting!

        So, lesson learned: it doesn't hurt to try something really silly when all of the sensical things just don't seem to be working.
        OK - from now on it's not a "Bankruptcy." It's a "Weight Loss Program." I'm in. Sign me up.

                  I'm out of town on a job. Just reading this, I applaud my wife, Mrs. C who has some Murphy blood, in her advice, PACER is not at fault, information is. I am so pleased she kicked a bk into a discharge for a wonderful OP to get he and his family moving forward to their new start. One hamster for her:

                      I'm resurfacing this post because it worked for Peeps and I didn't want to start a new thread. I'm waiting on Pacer to update with something...what I don't know...but my 341 was yesterday and I've read people getting updates on Pacer within hours...LOL...I'm impatient...but I'm sick of my Pacer status reading "waiting on first meeting" and "time in status 41 days"...

                        If I remember correctly, PACER updates in our case usually happened about 24 hours after whatever the event was. Rarely did the update happen the same day, and when it did, it usually posted after 6:00 PM. The one time it updated immediately was when we got our Discharge, and that was because the caseworker was watching for the copy of the marriage license.

                        Keep in mind that we are coming off of a major holiday weekend, which is also the unofficial start of Summer. Many people take a long weekend like this and stretch it into a week off of work. Also, your district may have a backlog of cases to work.

                          PACER is not a time machine. It really does nothing but hold documents for a case. It's is known as an Electronic Case Filing and Case Management system or CM/ECF as the professionals call it. It only does what it is told to do. Even if you watch the various timers and due dates... PACER doesn't do anything with them, unless instructed. In some Districts, CM/ECF is actually set to "autodischarge" and "autoclose" cases by itself. However, I would not count on that if there are any "flags" on your case.

                          In any event, it never hurts to call your case manager in the Clerk's Office and ask if something is holding up the discharge. In many cases, if there is nothing holding up the discharge, the clerk will do it over the phone!!!

                              My PACER still has a status of "Awaiting Confirmation". Yes, has been one year in that status, yet it is also discharged and closed. In my experience, one can't trust PACER for the "current" status of a case.
