Phone conference went well. UST rep was actually very kind and almost supportive. Explained that after she reviewed all of our documents and bank statements she can see we're not living extravagantly- there's no fancy cars or jewelry or vacations, etc. She's trying to find a way to get us a discharge without having to say the line items are what they are. AND, she revealed she's the oldest of 7 kids so she has some sympathy for the daily chaos that isn't represented in black and white numbers. And our attorney explained they don't really want us to be this test case for the judge's authority because "bad facts make bad law" but we have good facts. He's sure they would rather test it out on a debtor who owns a luxury home and vehicles and has a high income with little to no dependents, etc. I am really really really crossing all my fingers and toes here.
The end part of the conversation was CLASSIC though. She finally brought up the rent, and asked when the lease was up. We told her we moved last summer, and our rent is now down from $1700 to $1500, and that lease is up the end of next month. We told her we've been offered the chance to renew it and we'll likely do that. She asked why the rent is cheaper- is it in a poorer neighborhood, did rents go down, etc. I said "Well, it's a smaller house. It's 1200 sq feet". And simultaneously she and our attorney said "you have EIGHT people in 1200 sq feet?!". Yep, I explained there are 4 bedrooms, technically 3 since one is a "nursery" or office room with no window but we use it as a 4th, and how the kids are sharing the rooms. There was complete silence on the phone for a good 30 seconds. LOL (I'm sure she's thinking it's kind of hard to argue how our rent should be lower when we're already down to 1200 sq ft)
I think it went well. She asked our attorney to call her after the conference call was done. So I'm HOPING to hear back with GOOD news. Please please please keep sending positive thoughts and prayers our way!
OH- and no matter how this turns out, I'm contacting my congressmen and detailing the problems with the bankruptcy code and guidelines as they are and how my case has helped outlined those problems!
