Medical bills, who is responsible

    Unfortunately, when it comes to medical bills, most states (probably all), hold spouses jointly liable even if only one spouse was treated. It is known as the "family purpose" doctrine. So, if your husband incurred $20K in medical bills and only he files BK, the spouse is still on the hook for the debt.

          Hi everyone, I just wanted to post the answer the attorney gave me;

          "As a general principle, the fact that the insurance was through your wife's employer makes no difference as far as her personal liability for medical providers to you. In order to be obligated to pay the debt of another in Tennessee, you have to sign an agreement (in writing) to be obligated."

            Thanks jennyn, for that update. However since your attorney said "as a general principle," it will be interesting to see how the rules of your local BK court, and your individual trustee handles this.
