    Ch7-Asset but discharge says Ch7-No Asset??

    Hello!

    My parents filed Ch. 7 on 12/20/10. 341 was scheduled and continued 3x, but Trustee finally concluded on 3/16/11. Received notice of discharge on 04/05/11. Awaiting closing. PACER Case Summary says "Ch 7 standard discharge, no assets".

    My question is this: I don't see any Report of No Distribution/No Assets on PACER. But my parent's laywer told them to expect to 1) pay the trustee to keep their vehicle (worth more than they owe) and 2) expect to give up the land they own free and clear (5 acres w/ 2 unlivable mobile homes in rural area). Because of this, my parents assumed they were an asset case. During the 341 meetings, the trustee only asked for land survey and hasn't requested any other info on it or the car.

    Is it possible that the trustee is abandoning interest in the vehicle and land? There isn't a report of no distribution/no assets on the docket report or documents and nothing concerning it in the deadline tab. But there also isn't anything regarding intent to liquidate the asset either. There was ONE thing interesting on the schedule it said "Cert?NO ASSET?" and it was checked SATISFIED on 3/27/11-BUT when I opened the file the document was only for the bk course and had nothing about a No Asset Report.

    Just wondering what can happen/what to expect? My parents owe 2010 property taxes on the land, so we are wondering if they should go ahead and pay it or if it belongs to the bk estate?

    My guess, and its purely a guess, is that the trustee opted not to pursue the two assets. I wouldn't pay the taxes yet but I wouldn't spend the money either. Wait for the closing. Is there an attorney involved? Might want him to nose around. Good luck.

      that's the BEST news to hear...it's means the trustee has decided that there is nothing to pursue in your parents estate. while one rec's two orders from the court, to me, personally it's that no distribution of asset order that's more important than the discharge order... but that's me..LOL!!!

      if the notice has been signed, and if you see it on pacer that the trustee has abandoned the assets, (or thought them not worthy of going after), and they are on the road to a new debt free life...congrats to them!!
