    60 days have passed ..but questions now

    Hey everyone,

    My 60 days (I think) just passed today. I called my lawyer and asked him about the discharge and the 60 day rule. My lawyer said that it is indeed 60 days now, but I had ammended my filing to include some other creditors, we did this on March 4th.

    But my lawyer has said that the original date for my 341 meeting, which was Feb 16th, should still be the date that we should go by since no one has posted anything to pacer objecting, and the trustee posted his no disbursment letter and asked to be relieved from the case.

    So my question is, do I go by what my lawyer said that the 60 days are now up (and we can celebrate with a nice 12 yr old Scotch) or do I go by the amend date of March 4th, which means I have another few weeks to wait, for the 60 days to pass?
    (The creditors ammended on March 4th were duplicates of creditors, and the paperwork had just passed each other in the mail is what I think happened)

      60 days.....

      In general, I believe it best to view the "60" days as a ballpark figure. For my daughter in California, it took almost 90 days. Another person I know went up to 80 + days.

      Expecting exactitude may not be the best approach for the psyche.

        I'd listen to your lawyer. 60 days is the limit for objections-it may take longer to get your discharge but without any objections that is usually because of administrative backlog.

          Yes I had read the sticky that says that when you ammend you "exemptions" that the 30 days starts over again. But we didnt ammend the exemptions, we had ammended the "list of creditors" and had added them to schedule F so that is why I had asked my lawyer.

          He didnt seem to know if the 60 day rule applied to that situation, in so as, the 60 day rule started over because of the ammending of schedule F. So I figured I would ask all of you as it seems you all know more than my lawyer does at times. He isnt the sharpest tool in shed if you know what I mean. LOL
