    Filing Chapter 7 if you are above median ...

    There is a well respected bankruptcy lawyer in Va. (robertweed.com) who has been doing strickly bankruptcies for the last 10-12 years.

    In one of his ads he states that the eligibility cut off for a household of one is generally 5-6 thousand dollars above the state median to file for chapter 7.

    On the other hand, for families of two or more people the cut off is just about the same as the established median income for the stae.

    If this is true, why would a single person filing for a chapter 7 have an advantage over a couple or a family that is filing ? What am I missing here?

    does not make sense and is contradicts a statement he makes on his website that the state is tied for the worst as far as single people filing for chapter 7.
    go figure.

      There is some flexibility in the Median Income, but it depends on some variables.

      Filers with Priority Debt like Child Support, Alimony, Student Loans, IRS Tax Debt, etc, will have amounts to fill in in those spots.

      People who own homes will more than likely spend more for house payments than the allowable for rent. The excess Secured Debt can be amortized forward, as long as you have more than 5 years remaining on your Mortgage.

      There are places in the Means Test that some filers will have entries where other people won't. That will allow some people to make more than the Median and still qualify for Ch 7.
