I will be making the last payment to my attorney this Thursday, as well as signing my Chapter 7 papers. I would like to make the last payment in cash ($395) so the BK is filed immediately, rather than waiting for a check to clear. Does anyone see any problem with this, as long as I receive a receipt? Or is it better to pay by check?

yes, a check or cash is usually..or should be just fine.
we had to make payments for over a year....monthly by check.
i would ask your atty, but i would think, if you can, a check may be better on your bank statement if that is the way you have been paying the entire time. like newbie says, it should be fine provided you get the receipt. it will also be listed on your petition, because the atty must list their fees.8/4/2008 MAKE SURE AND VISIT Tobee's Blogs! http://www.bkforum.com/blog.php?32727-tobee43 and all are welcome to bk forum's Florida State Questions and Answers on BK http://www.bkforum.com/group.php?groupid=9

Cash would be better if you're filing immediately. That keeps your bank balance low at the time of filing. We paid our attorney all in cash ($1500) and had no issues.Filed Chapter 13 on 2-28-10. 341 completed 4/14/10. Confirmed 5/14/10. Lien strip granted 2/2/11
0% payback to unsecured creditors, 56 payments down, 4 to go....

actually, momofthree, that's a good point you bring up.
in the state we filed we were only allowed $150 in the bank account. that never happened even on the day of our 341 our balance was over 3k because we had not paid our bills for the month as yet, (rent, water, food, etc.,), so, when we supplied the 6 months of statements i don't think there was a day that our balance was $150...however, if you added up our expenses less the income we would had almost been under the $150! it was just a matter of timing or when during the month we paid what bill.
i think the trustee we had, was more interested in consistency in our spending and income and where our money was going than the amount exactly we had in the bank on our date of filing. but i know every trustee is different. i just felt it easier "record" keeping for the courts to see all of our in and out basis right on the bank statement for all to see.
but CASH is always KING!! LOL!!8/4/2008 MAKE SURE AND VISIT Tobee's Blogs! http://www.bkforum.com/blog.php?32727-tobee43 and all are welcome to bk forum's Florida State Questions and Answers on BK http://www.bkforum.com/group.php?groupid=9

Thanks for all the feedback, I'm going to go with cash only because I want to get this ball rolling and my attorney's office takes a week to deposit checks. I'll have a receipt for the transaction. And trust me, the cash payment or even the check payment, would drop the bank account balance, low, very very low. Sad but true.
