    Example of a Motion to Reopen ?

    Aaarrghh!

    Failed to file proof of completion of post-bk financial counseling. Case closed. Need to reopen to file. Anyone have an example of a motion reopen in Ch. 7? Figure it doesn't matter if not for specific instance.

    I have found the best way to find examples of motions/documents etc. is to go to google, type in "Motion to reopen bankruptcy" and then click on "images". Doing that just now I found a few.

    I will send you a link in private message to one that is for the purpose of filing the debtor's ed cert. Don't want to post it in forum, as it might be a little too much like advertising
    Filed pro se, made it through the 341, discharged, Closed!!!

      Thanks! This was a good idea, but I don't think I've found a good example yet. Will keep looking.

        Exactly... just find one on the Internet. First, this would be a Motion to Vacate Dismissal. Please be aware that this MUST be filed within the statutory limit for vacating an order of the court, which I think is 14 days now (it used to be 10 days).
        Chapter 7 (No Asset/Non-Consumer) Filed (Pro Se) 7/08 (converted from Chapter 13 - 2/10)
        Status: (Auto) Discharged and Closed! 5/10

          Here you go. . . It goes something like this. . . say what you need to say:

          Caption: DEBTOR’S MOTION TO REOPEN CASE FOR LIMITED PURPOSE OF OBTAINING A DISCHARGE

          Debtor hereby moves the Court to reopen the Chapter Seven proceeding for the purpose of obtaining a Discharge.

          1. On or about _____, 2011 the Clerk of the Court notified the Debtor that a Discharge could not be entered as he/she had failed to submit the required Certificate of Completion of Instructional Course Concerning Personal Financial Management.

          2. On ____, 2011 the Debtor completed the required course.

          3. On ____, 2011 the Clerk of the Court entered a Notice that the Case had been closed without entry of a Discharge.

          4. On ____, 2011 the requisite Certificate that the education course had been completed was filed.

          WHEREFORE, Debtor requests that this Court reopen this Chapter Seven for the purpose of entering the Discharge.

          Well, you get the point. . .
