    Money in the bank after filiing?

    Hi We filed Chapter 7 on Monday and I'm still stressing. My lawyer said it is ok to put money in the bank after the filing date but we are wary of doing so. Any money that went in would just be paid in bills anyway. So I'm not sure what I'm really asking. LOL Does the trustee continue to look at bank accounts?

    Yes trustees do look at bank statements through your 341 date. Not always but many do. As far as putting money in I think you need to be able to prove where it came from. If its from wages then you shouldn't have a problem. If it is from "under the mattress" no problem as long as you listed it on your filing. if it is a small amount not a problem-if a large amount it could rise a flag. Trustees are looking for inconsistencies between what is on your filing and what is really happening.

      Your lawyer is correct. Your date of filing is what the trustee is looking at, and all of the information to go with that date. Provided you have fully and truthfully disclosed your financial situation, you will have no problems.

        Thanks, I'm worried about a $400 check I deposited. Other than paychecks for regular bills nothing will be going in.

          we submitted 6 months of consistent bank statements with our petition...and in those statements where all our deposits and withdrawals for our daily living expenses.

          in the state we filed we were allowed $150 in the bank, but on our day of filing we had over 3k in the bank because our bills hadn't been paid yet.

          i do believe the trustee's are looking more for consistency, than anything else...if you pay the same thing with the same amount of money every month it's fine, and we absolutely continued to use our checking account, because if there was any further questions, at least we had them on our statements for proof.

          i think you will fine and as frogger states they are looking at a snapshot of what you situation was at the time of filing.

            Yes the trustee is looking at the snapshot on the day of filing. when i went to my 341 meeting the trustee just wanted to see bank statements up until the date of filing.

              Hi - how many months? My credit union just closed my account so I may be SOL on that respect...I have no longer any access to the checking acct.

              I have a letter from them showing acct in overdraft...

                IamOld - You may have to contact your credit union to get statements. That is what my attorney had me do, although I'd had paper statements always sent up until the time they closed my account. But I had to get something from them stating this had happened, for the 341 filing.

                Do you have any information on previous statements. This was the one thing the attorney was adament about and since my credit union had been bought out, it was like pulling teeth to get the information but they finally did send it to me. Took many phone calls until I finally reached a person who actually had a heart (must have been unemployed for awhille is all I can think of) and sent me statements from the day I filed.

                  Well, that's what I may have to do - they'll have their money on Tues at the latest, meeting with atty on Wed...if need be I suppose a fax from lawyer will dislodge it...

                    i had provided the statement i gave my attorney when i first turned in my paperwork in november, then the trustee asked for the statement as of the date of filing which was January's. that is all he wanted. sorry about your checking account.

                      THANKS!!!!! Well, atty didn't ask for it, and I can show letter to Trustee I guess...clearly shows NEGATIVE balance! Re checking acct....I know - not the way I wanted to leave them...I had opened an account at a small place a few years ago, so for now, I'm ok with that one...
