I am currently in a Chapter 13 and I am planning on converting to a Chapter 7. My first mortgage has a proof of claim in my Chapter 13 for 8 months arrearge payments and about $11,000 in an escrow account that was negative. My question is, if I catch up all the arrearage payments before the 341 meeting of creditors, would they be able to file for relief from stay and start foreclosure proceedings for my escrow balance? Please advise. I live in Wisconsin.
