    Charges less than 90 days before filing experiences...Challenged??

    Hello all,

    So, with help from some here I ve decided CH7 is my best option...plan to file approx May 10th...

    My question today is what were peoples experiences with charges that were less than 90 days from date of filing.

    I have approx 60K unsecured - about 2K was charged during latter part of Feb...I also have a couple of recently bounced checks from Telecheck and Certegy...(400.00 total).

    Do creditors really challenge stuff? Or does the trustee automatically dismiss stuff less that was charged within 90 days of filing?

    Or is it not worth their time for small amounts...?

    Anything charged within 90 days of bk is presumed to be charged with the knowledge that you were filing for bk. If the 2k was charged for food and living expenses, you might slide by, but how are you going to live after bk without the ability to charge?

    As to it not being "worth their time", you never know how the trustee or the creditor will react.

      If the charges are non luxury you should be OK.
      But, Frogger is spot on. Stop paying all debt you wish to discharge and use that money for living expenses. If you still can't make ends meet you have a problem bk can't fix.

        Stop bouncing checks, too. You can be pursued criminally for those!

          I also had a few (less than $500) charges within the 90 day window, but the way I understood it was that they could fight it and I would have to pay back the $500. That was well worth the risk, and I had reasons to file before that 90 days was totally up. So far, nothing...
