It appears you can exempt up to 25k of personal property for each person filing-cash is personal property - you should be able to exempt your cash of 660 some odd dollars if you are within the 25k limit. Or you could spend it on food, clothing, etc. Actually if it is exempt, then I believe you could spend it any way you wanted but why tempt fate?

Delaware lets you exempt up to 25k in personal property, which includes cash. Your 660 should be exempt. No need to spend. Only problem would be if you had 25k worth of other personal property to exempt. if so, I'd pass on exempting $660 of used furniture and use it for the cash-no trustee wants that.

I think you can leave it in the bank and exempt it. Delaware allows a 25k exemption for personal property-cash is personal property-so unless you have a gazillion dollars of personal property to exempt your cash should be safe. If you are over you can always chose to not exempt $600 worth of used furniture-no trustee wants that. On the other hand if you want it to be gone, spend it on food, gas, etc today.

Thanks for everyones advice!! I went ahead and got some personal neccessities( diapers, wipes, shampooo, etc), groceries, and we filled up both cars so I doubt we will have much left besides my money in the credit union at my job. I'm so ready for tomorrow at 5pm! Hopefully my next thread will be that I have filed and in the club waiting for my 341 meetingFiled Chapter 7 Bankruptcy 4/13/2011....................... awaiting our 341 meeting scheduled for May 31st 2011
