    Visitation Expenses

    I have a few questions.

    My wife bailed a year ago and took my son to NC. I stayed in MA and am coming out of the divorce with 60k in credit card debt. I have no secured debt. I see no realistic way to pay this off while paying child support, hence filing. I am over median. I do have a $500/month 401k loan for the next 4 years.

    My son is supposed to come to visit me 2-3 times a year (per separation agreement) and I'm on the hook for costs. Is listing $75 to $100 a month for travel costs reasonable? He's 13, so having him fly is expensive, with 'Unaccompanied minor' fees and/or needing direct flights. (lawyer: "maybe.") If allowable, I assume this would be an "Additional Expense Claim"?

    Next, the Additional Expense Claims are listed after the totals on the B22A (and C). I have the $200 'old car' expense listed there also. How are these accounted for? They would drop me to about $70 / month disposable on the B22A and quite negative on the C.

    Schedules I and J come out slightly negative using what I think are reasonable, reality based values, of course including the 401k loan. I'm hoping this leads to a Chap 7, but the lawyer isn't making me feel too good about it. I have no other reason to be in a 13, no non-exempt property, no secured debts.

    This is more a comment than anything, but why is "only on credit report for 7 years" listed as an advantage of chapter 13? Seems to me it's either 10 or 12, if you start the clock at the beginning.

    see several attorneys, other attorneys may be more optimistic about your chances. Don't just go with the optimist, but get one that seems like they are willing to fight the trustee to get a 7 if necessary.
