I want to reaffirm my home loan with WF. Per WF they don’t have an issue with me reaffirm. I’ve never been late with payments and I wish to keep my property. Per my attorney, he is 90% sure the judge will deny my request because judges in the eastern district of VA do not allow reaffirmations. I wanted to know if I could appeal the judge’s decision with a more qualified attorney? And can WF foreclose on my property if the payments remain current? I have 7K equity in my home and plan on staying there for 10+ years. My reason for filing bankruptcy is due to a bad business venture in which I cosigned for credit cards, etc. Please advise I love my home and want to reaffirm.

It sounds like the judge is doing people a favor by not allowing reaffirmations on home mortgages. If you keep paying your mortgage the lender is not going to want your house back. $7000 in equity is not enough for them to take it from you and try to sell it.

Wells Fargo won't take your house if you keep making your payments. You need to take a deep breath and relax. I know it's stressful, but honestly they will NOT want your house if you are current with your mortgage.Filed Chapter 13 02/2006 - Confirmed 05/2006 - Discharged 09/2011
