    Ford = moronic idiots!!!!

    I'll make it short:

    Filed 11/10. Wanted to reaffirm our Ford (at 11% interest). Judge said no. Wanted to redeem Ford. Ford said sure - at 24% interest. (Yeah, right). Tried to fight them in court. While waiting for our hearing date, received our discharge notice, so we went shopping. Got a brand new Dodge Caliber with ZERO interest and the payments are $100/month less than the Ford. Called Ford - told them to take their 24% interest and stick it . . .and where would they like us to drop off the car? They said take it to any Ford dealer. Which we did.

    Fast forward 2 weeks (to last night). Received an obnoxious banging on the door at 6:00 p.m. It was the repo man - looking for the Ford. WHAT!?!?! IDIOTS!! LMAO!! Sooooo. . .to get this straight:

    1. Ford could have let us do a ride thru (which they would NOT), at 11% interest, and just leave us be. Nope. (Would have been good for them, bad for us)
    2. Ford got really greedy, and tried to get us in at 24% interest. Um . . nope.
    3. Ford spent money on their attorney for the Motion to Redeem.
    4. Ford spent money on the repo man - AFTER we had already dropped off the car. (WTF?)
    5. Ford now gets to spend money to clean the car.
    6. Ford now gets to spend money to put the car back on their lot.
    7. Ford now has lost a lot of business because I have a big mouth and people can't believe their stupidity.
    8. We have a brand new car with a much better payment. WINNING!!! (Do I sound like Charlie Sheen? )

    FORD = IDIOTS!!!

    C-mom - glad this all worked out for you. I can't believe Ford pulled all that on you guys (well, ok....yes I can, but still....!)

      Saaweeet! So how did you manage to swing the new car AND 0%? Did the BK come up during negotiations? Did you have to put money down or negotiate less of a deal to get the car?

        Hi Brokeded! I honestly don't know . . .YES, the bk came up, we told him everything. It was luck of the draw - they were able to give a deal on a NEW car, not a USED car (I guess that's just how things work out nowadays). We put $1,000 down. The loan is for 5 years - and the warranty is for 7!! SAWEET indeed!

        I just can't believe Ford is so. . .well. . . I just can't believe them.

          Absolutely AWSOME!!!!! (Interestingly, my atty says that Ford is "hell" to deal with).

          May I ask 2 questions please?

          Why wouldn't judge allow you to re-affirm?

          AND - what were the Presumption of Abuse in your case???

            Hi IamOld! Yes!! You should read the posts by AlmostAmos - he dealt with FORD hell too!!

            Most judges don't like reaffirmations because it's really not in the best interest of the debtor. It's like saying, "Ok, I filed BK, but I'm going to continue to be responsible for this loan anyway," and God forbid you lose your job or get sick, you can no longer get out of it for at least 8 years until you could file 7 again. For some reason that I still don't understand, some reaffirmations on cars are ok (if they are with credit unions, which one of our cars WAS, so we were able to reaffirm that one).

            The POA was because we did not pass the means test, but my dh got laid off. So according to the 6-month look back, we didn't pass. However, we were not dismissed because of the special circumstances - he was now laid off, so our income continued to plummet every month.

            The good news is that dh DID go back to work. It is construction, so it's always a question of for how long, and how long will he be laid off again? But we will never, ever, ever, EVER use a credit card again. That's what got us into trouble.

              Understood!!! I don't mind not signing a reaffirmation AS LONG AS we get to keep our cars (1 for me 1 for spouse) there is ZERO - NO - NONE - public transportation where we live - no car=no work.

              I'm very glad to hear about your husband!!!

              I think we'll pass the means test with our deds - spouse has TWO chronic health conditions=large med expenses, etc. I got laid off too - new job not as much as old job, but have P/T job that can be a lot or nothing....

              I think I'm learning not to be scared of Ch 13 - dear God I just want to get started!!!

              And you're right - if we get to the other side of this swear right now - I do NOT EVER EVER EVER want another credit card of ANY kind!!!! Or loans (other than car) - NOTHING EVER AGAIN!!!

                Best of luck to you IamOld! This is a process. . .and as long as it is, it may as well be a learning process too! This forum is FANTASTIC. I couldn't have done it without the people here. I learned a lot - and I've learned my LESSON! I don't buy it unless I have to! And I'm with you - only car loans and my mortgage. Those are the only debts I'm willing to have. Everything else is just silly.

                    Yep, as clevelandmom said - check out my posts about this (from early December '10). I ended up having to get the President & CEO of Ford involved... But, I was able to keep my wife's car (purchased 6 months prior to filing). Actually, Ford really pulled through for me. It was my freakin attorney that screwed the pooch. Read it, it was an interesting time for sure.

                          Way to go Clevelandmom - Here in the MotorCity (not sure if other states have these sayings or not) we call Ford - F*$% Over Rebuild Dodge

                          I just received a letter today from my OC on my 2002 Dodge Grand Caravan and the first sentence made me lol... "We have your vehicle described above because you broke promises in our agreement". This one almost made me pee my pants.."The money that we get from the sale bah, bah, bah... will reduce the amount owed. If we get less money that owed, you will not still owe us the dfference. IF WE GET MORE MONEY THEN OWED, you will get the extra money, unless we must pay it to someone else." Yeah Right !!!

                          So if anyone is in MI, is looking to bid on a 2002 Dodge Grand Caravan with 89K (yes -the mileage is correct it's the only reason I purchased it) please start that bid at 12K hehehehe
