    I don't know what to do. I just want this to be over with.

    Our 341 is Monday morning. We have a straight forward ch 7.

    I was asked to bring along photo ID, Social Security cards and then the last pay stub for each of us and the last 4 months statements on all savings/checking accounts.

    I have been saving everything so I would be ready for this meeting. I am placing everything in a folder this morning so we would be good to go BUT, I find I have all but ONE statement?!?!?

    I am missing my February statement on one account. The Nov, Dec, Jan statement amounts are all the same. My access was terminated from my online account so I cannot print one. I'm at a loss. I am thinking that I did not get one. Is it possible they stopped sending them? I have searched both vehicles, covered the desk top to bottom, my purse, briefcase....Its not here!

    My letter states that I must have ALL the information requested or they will ask for a continuance and I will have to pay another attorney fee. Does anyone have any ideas?

    Is there any reason to hope that if I call them tomorrow they may fax it to me? If it exists. I THINK they stop sending them at some point but I don't know at what point that is. We stopped paying them 7 months ago.

    Honestly, say your truth on Monday. You may NOT have your Feb. statement. Oh well- you have all others, and, if you've had a zero balance for a couple of months, your account will close, so no Feb. statement without a special rquest.

    If you have everything else, don't panic over this one document.

      You say that you stopped paying them 7 months ago.

      So you dont have a credit card statement? is that what you mean is missing?

        Explain to the trustee exactly as you did here, and tell the trustee that as soon as the 341 is over, you're going to get a copy of the statement and you will fax it to them.

        Shouldn't be any problem.......

          I had a similar situation where my old bank, which I owed for cc and overdraft protection, stopped sending statements and I did not even realize it until the attorney told me what to bring to the 341. I called the bank when I could not get into my account to print one out the current statement and collections said they had written it off. I asked how I would find verification of that and she had no idea.

          I then talked to my attorney and was told just to bring the last statement I had and the prvious statements I'd already submitted would show that it had the same debit balance for some months. Then, just on the off-chance that I could talk the bank into sending me something I called them back. A different person (one with a heart) said she would send something that shows the account had a different line item code. Not sure what she was talking about to be honest, but that along with the last statement should be proof enough for the trustee. (At least I hope it is!)

            Thanks everyone. Now that I have calmed down and had a good nights sleep I looked over my statements. Four months ago it read VISA LOAN, three months ago it had SUSPENDED and then in January it read CHARGED OFF BANKRUPTCY, the interest rate was 0% and there is no late fee etc. I think I am good. I did try calling this morning and they said the account is locked and requires security override to access. That I would have to call Monday for that. I'm just gonna let a sleeping dog lie. I believe that everything is ok.

            BK is just like waves of horribleness one after the other.

              A question if I may - does the Trustee actually LOOK go/trhu your bank statements OR does he/she just take it?

              Mine are LOOOOONG - lots of bills to pay and (yes I know the stupidest thing of all) payday loans...which is one of the reaosns I'm here - so lots of NSF's in/out small transactions....but I guess I hope if he/she TRustee sees that they'll just think (correctly) that I'm stupid. Any thoughts? I'm going with my spouse and things are not well between us and I just don't want the spouse to "blow up" at me duirng the 341. So...do they look at all of it right then and there?

              Is being up to your eyeballs in debt I guess that's ok...

              Another question (sorry) Ive heard here that some people had to just bring something that showed how much money they had that day, some 3 months, some more...any rhyme or reason???

                IamOld - I would think they do look them over prior to the 341. I know I have to bring the statements from the day I filed but previously gave my lawyer six months worth which I'm sure were shared with the trustee. It seems that each trustee is different and asks for different things i.e.; the 3 months statements at the meeting. Your lawyer might have the logic behind that. Or some of the gurus here on the forum.

                Ugh - I'll bet all you need is the one that says charged off. My lawyer would love it if I had one like that.

                  SIX months - wow - that'll be like...300 pages!!!! I need to go into bankruptcy for the cost of the printing!!!!! By the way my lawyer didn't even bring up bank statements yet...

                    I was told to bring my bank statements to the 341 meeting also, 6 months worth. I brought them along with tax returns for 2010. He looked over the tax return briefly, didnt even ask for the bank statements at all. Then 2 weeks after the meeting he asked for copies of both, so I faxed them to the lawyer and that was that.

                      Wow - for me that'll be a LOOOOOOOOOOOOOOOOONG fax.

                      Tax question - I won't be able to file 2010 because I'll owe...(yes I know) but I should be able to pay by Oct/Nov - if I have the return but unfiled BUT will have filed extension form will that be ok? THere is NO - SUBZERO chance of refund (putting it mildly)...just can't pay the IRS and since I have a payment plan already I cannot file unless I can pay...

                        It was a long fax for me also. It took over 75 minutes to send all the documents for the tax return and bank statements. and thats with an autofeed fax machine with a deidicated fax line.

                            Wow - I went to Kinko's and even with 6 moths of bank statements, income tax returns for 4 years, bills for 6 months (cc and regular), unemployment info (for a year - was only two pages), car title and copies of pay stubs from my temp job it was under $30 - in fact I think it was more like $15. Then I drove it all to the lawyer's office.

                            You must have had SOME paperwork BAR.
